Analytics Data: We use third-party analytics tools (including Google AdMob SDK for analytics purposes only, without displaying ads, Facebook SDK, and AppsFlyer SDK) to collect data about App usage, performance, and user engagement. 3. How We Share Your Information
We may share your information with the following3 categories of third parties:
Service Providers: We engage third-party service providers to perform functions on our behalf, such as hosting, data analysis, customer support, and4 analytics. These service providers have access to your information only to perform these tasks on our behalf and are obligated not to disclose or5 use it for any other purpose.6
Analytics Providers: We use Google AdMob SDK (for analytics only), Facebook SDK, and AppsFlyer SDK to collect and analyze usage data. These SDKs may collect device identifiers and usage information. While we use these SDKs, we explicitly configure them not to display advertisements within our App.
Payment Processors: When you make in-app purchases, your payment information is processed directly by Apple's App Store or other designated payment processors. We do not store your payment card details.
Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred7 as part of that transaction.
Legal Requirements8 and Law Enforcement: We may disclose your information if required to do so by law or in the good faith belief that such action is9 necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) act in urgent circumstances to protect the personal safety10of users of the App or the public, or (d) protect against legal liability.11
With Your Consent: We may share your information with third parties when we have your explicit consent to do so.

We retain your information for as long as your account is active or as needed to provide you with the App's services. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes,12 and enforce our agreements.

Push Notifications: You can enable or disable push notifications from the App through your device settings.

Terms of Use for Fitness Pro Elite

These Terms of Use ("Terms") govern your access to and use of the Fitness Pro Elite mobile application (the "App") provided by Fitness Pro Elite ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms,18 you may not access or use the App.
1. Acceptance of Terms
By accessing or using the App, you19 acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between20you and Fitness Pro Elite.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into21 these Terms. If you are between 13 and 18 years old, you must have the consent of your parent or legal guardian to use the App.
3. App Access and License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the22 App on your personal iOS device for your personal, non-commercial use. All rights not expressly granted to you are reserved by Fitness Pro Elite.
4. In-App Purchases and Subscriptions
Subscriptions: The App offers premium features and content through paid subscriptions ("Subscriptions"). Subscriptions may be offered on a monthly, annual, or other periodic basis as described in the App.
Payment: All payments for Subscriptions and in-app purchases are processed securely through Apple's App Store. You agree to abide by the terms and conditions of Apple's App Store regarding payments.
Auto-Renewal: Subscriptions may automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.23
Cancellation: You can manage and cancel your Subscriptions through your Apple ID account settings. Canceling a Subscription will stop future charges, but you will retain access to the subscribed content until the end of the current billing period. No refunds will be provided for any unused portion of a Subscription term.
Price Changes: We reserve the right to change our Subscription prices at any time. We will provide you with reasonable prior notice of any such price changes.
5. Health Disclaimers
Not Medical Advice: The information, content, and services provided within the App are for informational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of24 a qualified healthcare professional with any questions you may have regarding a medical condition25 or before starting any new fitness or nutrition program.
Consult a Professional: You acknowledge that physical exercise and fitness programs can be strenuous and involve inherent risks. You should consult with your physician or other healthcare professional before beginning any exercise program or making any changes to your diet, especially if you have any pre-existing medical conditions.
No Warranty: We do not warrant the accuracy, completeness, or usefulness of any information provided in the App. Your reliance on any information provided by the App is solely at your own risk.
6. User Conduct
You agree not to use the App to:
Violate any applicable laws or regulations.
Infringe upon the rights of others, including intellectual property rights.26
Transmit any harmful, threatening, abusive, defamatory, or obscene content.
Engage in any activity that could disable, overburden, or impair the proper functioning of the App.
Attempt to gain unauthorized access to any portion of the App, other accounts, computer systems, or networks connected to the27 App.
Use any automated system, including "robots," "spiders," or "offline readers," to access the App in a manner that sends more request messages to our servers than a human can reasonably produce28 in the same period by using a conventional29 web browser.
7. Intellectual Property
All content, features, and functionality within the App, including but not limited to text, graphics, logos,30 icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Fitness Pro Elite or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
8. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach31 these Terms. Upon termination, your right to use the App will immediately cease.32
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED,33 INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED,34 SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.35
10. Limitation of Liability
IN NO EVENT SHALL FITNESS PRO ELITE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,36INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE37 APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT,38 TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
11. Indemnification
You agree to defend, indemnify, and hold harmless39 Fitness Pro Elite and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims,40 damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of the App or your breach of these Terms.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws , without regard to its conflict of law provisions.41
13. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
14. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Fitness Pro Elite regarding the App and supersede and replace any prior agreements, oral or otherwise, regarding the App.
15. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material,42 we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
